Mrs Audrey Swales is trying to piece together what happened to her late husband, Deryk, who died last year aged 79.

Mr Swales, of Ravenoak Lane, Worsthorne, died from asbestosis, the lung disease which develops as a result of exposure to asbestos. He had lived for most of his life in Burnley and worked at the English Electrical Company and at hospital sites in the area.

Solicitor Katrina London, of law firm Irwin Mitchell, is representing Mrs Swales. She said: “Audrey believes Deryk was exposed to asbestos during the course of his working life at the English Electrical Company and Burnley hospitals during the ’50s, ’60s and ’70s, and we would like to hear from anyone who worked with and knew Deryk Swales at either of these locations.

Carpenters ‘face asbestos death’

One in 17 UK carpenters born in the 1940s will die of the asbestos-related lung cancer mesothelioma, researchers predict. They also calculated the deadly disease would strike one in 50 plumbers, electricians and decorators and one in 125 other construction workers. The UK mesothelioma death rate is now the highest in the world, with 1,749 deaths in men in 2005.

The study appears in the British Journal of Cancer. The researchers calculated the lifetime risk of the disease among workers exposed to asbestos for more than a decade before the age of 30. Their findings were based on interviews with more than 600 patients with mesothelioma and 1,400 healthy people.

Over all, the projected lifetime risk of fatal meothelioma in all British men born in the 1940s was about one in 170. For every case of mesothelioma, asbestos also causes about one case of lung cancer, so the overall risk of asbestos-related cancer for carpenters born in the 1940s was about one in 10.

The authors also found that around two-thirds of all British men and a quarter of women had worked in jobs involving potential asbestos exposure at some time in their lives. There was also a small increased risk in those who had lived with someone who had been exposed to asbestos.

$2.25 million awarded in asbestos death.

A Buffalo jury has ordered a St. Louis-based supplier of industrial control valves and control systems to pay the estate of a Niagara Falls man $2.25 million for the former Hooker Chemical repairman’s death from cancer, court officials confirmed Wednesday.

Following a six-week trial, the jury held Fisher Controls financially liable for the asbestos-caused mesothelioma that killed Ronald Drabczyk. He died at 70 on Nov. 29, 2005, nine years after his retirement from the Niagara Falls plant.

Lower Your Asbestos Removal Cost

The Asbestos removal cost is a small price to pay for the safety of your health and that of anyone in your property. If you have damaged or distressed asbestos containing materials in your property, they can release dangerous asbestos fibres which are a serious health risk. This situation can be avoided by the safe removal of any asbestos containing materials in your building.

A complete Asbestos removal cost will include the identification of asbestos materials in your home and the implementation of the appropriate removal procedure. There are many places within buildings where asbestos can be found including asbestos tiles, guttering and drainpipes.

In all instances if the asbestos material has been damaged then it is essential that it is removed by following the correct procedures. Ultimately, whatever the Asbestos removal cost, it is a very small price to pay for the safety of you and other occupants of your property.

While it can be tempting to do a ‘DIY’ job on the removal of any asbestos products to reduce the asbestos removal cost, you could put yourself in grave danger. Any asbestos removal process will disturb asbestos fibres causing some to be released, if you’re not properly protected the asbestos removal cost may be to your health.

How Do I Get the Best Asbestos Removal Cost?

Asbestos removal should only be done by a certified professional who is trained to seal off the affected area, remove, and properly dispose of asbestos. If the process is not completed correctly, it could pose major health threats to those who frequent the area affected, as well as surrounding areas as the asbestos fibers will travel in the air.

Keep in mind that when a person is exposed to asbestos fibers in the air, their chances of developing health problems in later years is increased . Lung and stomach cancer are the results of long-term or high exposure to airborne asbestos fibers. Asbestos can be found in popcorn ceilings, floor tiles, insulation, old house heaters, and various other locations in a building.

Check with a number of different asbestos removal professionals to obtain price quotes and choose the option that will work best for your situation. Some contractors will charge a set fee, regardless of the size of the job. Others will charge by the amount of work involved, therefore if removal has to be done in various locations the cost can easily be driven in to the thousands. The asbestos removal cost will more than likely be determined by how many different areas are affected and the difficulty of the removal process.

Your home or business should first be inspected by a removal company, and then a different company should be contracted to do the removal. After this, you should contact the company that did the inspection to do a follow up appointment. This forms a sort of checks and balance system so that you get the best service for your money and the deteriorating asbestos out of your residence.

Be sure that any asbestos removal cost includes the clean up and disposal as well. There are state and federal regulations that removal companies have to follow, and you should see these outlined in any contract that you sign. Also, check with the Better Business Bureau for any complaints or problems about a removal company.

Asbestos encapsulation refers to the actual sealing of asbestos within a protective shell. This is done for a number of reasons, but the main reason is that removing all asbestos materials from some structures is nearly impossible. Therefore, various manufacturers have devised capsules that are meant to contain all asbestos toxins without demolishing an entire structure.

In fact, scientists have discovered that attempting to remove asbestos from a building is more harmful than simply covering it up. When asbestos has been disturbed, small particles of the toxin drift into the air. As a result, an air space can quickly become contaminated. Therefore, the best solution is to manage asbestos by containing it using asbestos encapsulation techniques.

Any exposure to asbestos is a health risk. Asbestos has been directly linked to lung cancer, fatal asbestos disease, mesothelioma, emphysema, and gastric cancer. Interestingly, exposure to a low level of asbestos seems to cause as much health damaged as exposure to a high level of asbestos. Homeowners and building owners that own structures laced with asbestos are urged to contain this harmful toxin as quickly as possible.

Asbestos encapsulation is a lot more cost-effective than completely removing asbestos. As previously mentioned, the removal of asbestos is not recommended, though this procedure is possible with professional help. While asbestos removal is an expensive procedure, simply covering up an asbestos problem with encapsulation proves to be a much cheaper alternative.

While it might not seem safe to cover asbestos, the truth of the matter is that asbestos encapsulation is a very safe procedure when done correctly. However, any pipes or materials containing asbestos that are not in good condition should not be maintained. Pipes and materials that are not in good shape should be removed from a building by experts as quickly as possible.

Many asbestos encapsulation products on the market can be used by consumers, though this is not always recommended. In order to ensure that asbestos does not seep into the air, this toxin must be properly contained. Therefore, hiring a professional contractor to apply encapsulation materials is the best course of action.

There are many different asbestos encapsulation products available, and which product is used depends on what type of surface or item is getting the asbestos encapsulation. There are types of asbestos encapsulation for surfaces that reach high temperatures, and types of asbestos encapsulation for pipes, pipe coverings, beams, ceilings, and other materials.

Asbestos encapsulation can also be done by sealing off any areas containing asbestos with an air proof barrier, which can be made from sheetrock, plywood, polyethylene, plastic, plaster, or paint.

The Environmental Protection Agency doesn’t recommend asbestos encapsulation where the asbestos is more than one inch thick, water damaged, has poor cohesive strength, or where the asbestos is accessible to the people who are using the building. In these instances it is better to remove the asbestos to minimize the risk to the occupants of the building.

The problem with these fibers is that they are so small they can easily become airborne.

If the fibres are inhaled then they can cause many health complaints, many of which are ultimately fatal. If anyone is exposed to a high amount of asbestos fibres in the air then there is a much bigger risk that this person will develop cancer or other related conditions. Asbestos is seen as a very dangerous substance, and although there have been no safe thresholds identified, it is very important to avoid all contact with it.

The best way to remove asbestos while remodeling your home is to hire asbestos removal companies leading a team of certified professionals. There are many asbestos removal companies who undertake the projects of asbestos removal; therefore you should consider the following tips before hiring a asbestos removal contractor so that you should not get into the wrong hands.

The contractor should have a license issued by the local authority to do the job of removing asbestos in your state. You should speak to the previous clients about services offered by the contractor to them so that you should get a clear picture, whether the contractor is providing good services or not. You can also check out the reviews and testimonials of the contractor by visiting the website. You should try to obtain multiple bids from various contractors in order to get a competitive picture which will help you to choose the best contractor.

If you’re considering removing of asbestos yourself, consider this is saving a few dollars worth risking your long-term health? A professional asbestos removal company – has the tools and the gear necessary to safely dispose of asbestos. They know precisely how to handle the toxic material to keep safety at a maximum. Better still, they can dispose of it for you, meaning that you don’t have to worry about finding an approved spot or getting the right packaging to transport it safely. Considering the health concerns and the complex logistics of removing asbestos, it makes sense to let trained professionals do it for you.

Asbestos removal is the process of ridding a building or material of the asbestos that it may have been originally built with. Abatement companies all over California are busy with asbestos removal, in part due to the influx of asbestos litigation and mesothelioma lawsuits. Asbestos removal by a professional abatement company is only a fraction of the cost of a mesothelioma lawsuit.

Asbestos litigation can cost a company millions while asbestos removal companies only costs a few thousand dollars by comparison. Granted, large companies may have to spend more than a drop in the bucket to an abatement company for adequate asbestos removal, but it is still only a drop in the bucket when compared to the cost of a mesothelioma lawsuit, not to mention the human cost.

By following through with asbestos removal, juries do notice that there is obvious concern for employee health at a later time and do take that into consideration. Most asbestos removal companies who are involved in asbestos litigation are under new management or ownership by the time asbestos litigation is filed, and the public appreciates a minimal effort of asbestos removal.

Of course, this changes nothing for a mesothelioma victim, and asbestos litigation is still necessary in order to attain the financial means needed to fight for their lives. Doing something is still better than doing nothing.

No doubt you’ve heard of asbestos and that long-term exposure to it can be fatal. So what exactly is it? Well, asbestos is used to describe certain fibrous minerals that have great fire-proof and insulating properties and high levels of strength. These qualities have led to asbestos being widely used in construction for years in things like roof coatings, tiles and fences, sheeting, piping, car components like clutches, brake pads and transmission parts as well as mill and roll board.

If you breathe in or swallow asbestos fibres then exposure over a period of time can lead to a number of health concerns. Exposure over time has proven to damage lungs significantly because each time it is inhaled the small fibres stick to lung walls.

The diseases that can be caused by this include mesothelioma, lung cancer, pleural plaques and asbestosis. If you’re a smoker than the chances of getting one of these diseases following exposure to asbestos are much higher.

Below is some information about the major diseases caused by long-term exposure to asbestos:-

Asbestosis

This disease is a progressive disease. It occurs when inhaled asbestos particles scratch the lining of the lungs and cause scars. The scarring makes it difficult for oxygen to pass from the lungs and into the blood stream.

Some of the symptoms of asbestosis are having shortness of breath, and hearing a crackling sound in the lungs when you breath in.

At the time of publication there is no effective treatment for asbestosis.

Lung Cancer

This type of cancer is the biggest killer of all diseases related to asbestos. Most commonly, the diseases affects those people that used to produce asbestos materials or work with them regularly.

Some of the most common symptoms of lung cancer are breathing pattern changes and coughs. It is not unheard of to also have chest pains, anemia and difficulty breathing.

Mesothelioma

Mesothelioma is a type of cancer found in the chest, abdomen, heart and lung membranes. Just about 100% of the cases of this disease are caused because of asbestos exposure. Typically, this disease shows no signs for many years after the exposure to asbestos has happened.

Given the nastiness of these diseases asbestos should be treated with caution. Instead of tackling an asbestos removal project yourself you should consider hiring asbestos removal contractors to minimise the potential harm to those you love.

If you have been exposed to asbestos and are worried, contact a pulmonologist; they specialise in lung diseases.

The purpose of asbestos settlements is to help the victim of asbestos related diseases with money to cover medical expenses. In worse cases, it was meant as a compensation for the loss of income over the years, and the potential earning capacity of an individual.

The government has set up regulations that limits asbestos exposure with the permissible limit for exposure being 0.1 fibers per cubic centimeter for an eight hour workday. For every 30 minutes of work period, fibre exposure should fall below 1.0 fibre per cc. Statutory health protection measures such as these have been mandated.

The process of asbestos settlement puts the onus on the employer to compensate victims of asbestos related health problems. In case the company fails to adhere to these stipulated protection rules, resulting in adverse effects for its workers, the company is legally bound to pay settlement to the affected workers as compensation.

There have been numerous cases of asbestos settlements in the United States, after the awareness towards asbestos as a health hazard grew. Two of these famous cases happened in 1997 and 1999. Both these cases involved huge settlement class actions. In the end, both these settlements were overturned by the court.

There are also allegations of asbestos settlements having become a full-fledged industry, where the party benefiting the most are the attorneys, as they get a part of the settlement as fees for fighting the cases.

It can take between 10 and 60 years to develop, but usually averages 30 to 50 years before victims notice enough symptoms to see a physician.

Despite its name, it is not actually lung cancer as the lung tissue is not the primary site of malignancy. Instead, it is the supporting tissue around the lungs that becomes cancerous. This tissue around the lungs accounts for around 75% of the diagnosed cases, but similar tissue around other organs can also be primary sites of cancer initiation.

Currently there are between two and three thousand new cases diagnosed in the United States each year (U. S. National Cancer Institute, 2002).

This condition accounts for approximately 75% of the cancer caused by asbestos exposure.

Asbestos is a mineral deposit having the quality of heat insulation. It was used extensively throughout the world over the last century in the military, building construction, and consumer products until it was banned for carcinogenic effects. People can be exposed in the community, at work, in schools, at home, or even from the clothing of others who have been exposed. It is likely that most people have been exposed at some time in their lives.

This mineral’s composition creates a quality that is very friable. It breaks into chunks and then disintegrates easily. This allows microscopic particles to rise into the air where they will float undetected for long periods of time.

People can inhale these mineral particles without knowing it. The microscopic particles travel through the lungs, through the alveolar air sacs, and end up in the supporting lung tissue. They are impossible to remove, so the mineral particles stay there for life. They can slowly cause malignant cancer.

This condition is currently considered incurable. Usually there are very few symptoms until the later stages when the cancer has metastasized. After diagnosis, survival time averages between one and two years.

Early detection offers great advantages. It is always recommended that people who suspect they might have had some environmental exposure find a physician with specialized training to monitor their condition as soon as possible.

Treatment may include chemotherapy, radiation therapy, and surgery.

After decades of experience, medical research is now focusing on slowing or preventing the progression of this cancer. By learning all the biochemical pathways involved in the initiation, progression, and proliferation of cancer, scientists hope that they can find ways to change how cancer develops.

Since asbestos lung mesothelioma can take decades to develop into the fatal malignant state, there is hope that finding more early interventions will allow people to live normal lives. Researchers are exploring new therapies including natural substances that have shown positive laboratory findings in cancer prevention.

Given its special property, asbestos is used in things that require heat or fire resistance such as brake shoes, gaskets and other equipment that require heat insulation at very high temperatures. On the flip side, inhalation of a few types of asbestos has a very harmful effect on the human being. It is believed to cause many diseases, including cancer (mesothelioma), because of which many types of asbestos have been banned in most countries.

When its harmful effects were discovered, the United States included a law against it (Section 112 of the Clean Air Act of 1970), naming it a hazardous air pollutant. Ever since this law came up, there have been countless lawsuits against companies dealing with asbestos. The case against asbestos is so severe that, today, companies dealing even peripherally with asbestos have been slapped with lawsuits by people who claim that the asbestos has caused them physical harm or exposed them to potential harm.

Since most of the industries in America have some use or the other for asbestos, there are lawsuits worth billions of dollars pending in the courts; many companies have filed for bankruptcy and are facing heavy liability claims.

The results of a study conducted have revealed that out of the total money spent on asbestos litigation, not even half has gone to the effected or injured parties. Most of it has gone into attorney fees and other costs. It was estimated that, in the 1990’s, asbestos related deaths peaked in the U.S. Since then, lawsuits have been on the rise. A few of the cases have involved huge settlement class actions. As a result, many reform bills have been passed in different states to regularise asbestos claims.

While there have been several genuine cases, there have been an equal, or even larger, number of asbestos litigations, which seemed fraudulent, since the clients did not suffer any injury apart from asymptomatic pleural plaques. Because of such false claims, those that have actually suffered from asbestos have had to be content with a lower amount of compensation.

It was, therefore, a widely used material, particularly from the 1930’s – 1980’s and exposure still continues wherever it is disturbed / removed.

The cost of asbestos claims in the UK could reach £20 billion in the next 30 years.

Claims can be made by Claimants, even though the exposure was 30 or more years ago, and the past employer(s) has gone out of business.

Claims can also be made for deceased Claimants on behalf of their loved ones/estate.

Successful ‘secondary’ claims for Asbestos exposure have been made by spouses, children and grandchildren, after they were exposed to harmful fibres on work clothes worn home.

The compensation obtained can, in many cases, amount to well in excess of £100,000, depending upon the severity of the particular disease.

Asbestos has no respect for socio-economic group or occupation. There are over 1,000 new cases of Mesothelioma reported every year in the UK. It is generally accepted asbestos is the cause.

The types of occupation where exposure can be found/occur include the following:-

Asbestos Cement Products Industry (used for strong, inexpensive building materials, eg tiles, corrugated roofing, gutters, water and drain pipes, chimneys etc.

Floor tiling industry

Insulation and Fire Proofing

Carpenters

Electricians

Power Plant Works

Plumbers

Roofers

Central Heating and/or air conditioning contractors

School and Hospital workers

Ship workers

Symptoms can include breathlessness and persistent coughing which may cause sleepless nights leading to fatigue. Some sufferers report chest pain and feeling as though a heavy weight is pressing down on their chest, depending upon the particular condition. There are a number of state benefits available to victims and their carers. A specialist Solicitor can not only pursue compensation claims for sufferers on a true No Win, No Fee basis, but also provide advice and assistance with applications in order to maximise benefit entitlement.

Asbestos exposure raises the chances of someone dying of lung by 700% compared to people who are not exposed the Asbestos. The risks of getting any type of lung cancer is substantially higher for those who have been exposed to Asbestos in the past. A rare type of cancer that is to believed to be directly caused by Asbestos exposure is Malignant Mesothelioma. This type cancer directly attacks the lining of the lungs. It slowly kills the cells in this lining. Over time patients begin to get less oxygen absorbed into the bloodstream. The lack of oxygen can begin to have detrimental affects on many other ares of the body, including brain function for several years before the patient knows they have Malignant Mesothelioma.

The lining in the lungs is called the pleura. This is also the area that is infected in patients that have the disease pleurisy. Malignant Mesothelioma and pleurisy are in no way related and people who contract pleurisy should not think that they are at greater risk for Malignant Mesothelioma.

Asbestos was very commonly used for construction until around the 1950’s. At that time it was found that there was a link between Asbestos and cancer in the lungs. For asbestos to be dangerous a person must inhale the fiber particles such as would be released if you were sand it with sandpaper. Because of this fact there are still building today that contain Asbestos materials. It is believed that to remove it would actually increase the danger to the public for exposure. The removal would most likely cause the release of particles into the air.

Asbestos related lung cancer has many of the same symptoms as other forms of lung cancer. They include: shortness of breath, wheezing, chest pain, coughing up of blood. For those who are affected by Malignant Mesothelioma there is a class action lawsuit that has been under way for several years. these patients are urged to check into it. Most patients are entitled to a significant judgement
